Biographical Information

I have spent most of my life in the state of Colorado, and in the City of Colorado Springs. Prior to joining Retherford, Mullen & Moore, I served as a Prosecutor at the Colorado Springs City Attorney’s Office for more than seven years – most recently as the Chief Prosecuting Attorney.

My civil liability defense and insurance defense practice at Retherford, Mullen & Moore involves regularly taking depositions of plaintiffs, expert witnesses and lay witnesses, extensive legal research and motions practice, and litigating cases through trial.  Some of my accomplishments since joining RMM include:

Defense verdict in jury trial in a premises liability case in which I represented a publicly traded corporation.

Verdict involving a finding of 30% comparative negligence on the part of a Plaintiff in a bench trial involving an automobile accident case regarding property damage claims. 

Defense verdict in a bench trial regarding an automobile accident. 

Prevailed on a Motion to Dismiss in a premises liability action brought against a municipal enterprise.

Prevailed on a Motion to Dismiss in a state lawsuit against a physician.

Prevailed on Motions to Dismiss in lawsuits against hospitals on several matters, in state and federal court.

Prevailed on a Motion for Partial Summary Judgment with respect to a major component of the Plaintiff’s economic damages claims in a hospital liability case involving birth injury claims.

Prevailed on a Motion for Summary Judgment filed on behalf of a physicians’ practice group pursuant to the Corporate Practice of Medicine Doctrine.

Worked towards the voluntary dismissal of litigation where possible, including:

Voluntary dismissal of claims against a small business defendant in a property damage case after depositions of defendants and after filing a motion for sanctions for spoliation of evidence

Voluntary dismissal of a premises liability claims against a corporate client after conferring with plaintiff’s counsel regarding a review of applicable legal documents and legal research regarding a tenant’s duties in common areas associated with a leased premise.   

Voluntary dismissal of negligent entrustment and family car doctrine claims against one of two defendants in a personal injury automobile accident case.

Successfully briefed the appeal of a defense verdict to the Colorado Court of Appeals regarding a medical negligence/hospital liability case.  Gasteazoro v. Catholic Health Initiatives Colorado, 2014 WL 5073152 (Colo. App. 2014)(cert. denied in 2015 WL 5214601).
